EXECUTIVE ORDER NO. 40
ADVANCING THE JUVENILE JUSTICE PLANNING COMMITTEE
WHEREAS, effective juvenile justice policies and programs promote public safety, improve outcomes for juveniles and their families, and enhance juveniles' long-term educational, employment, and life prospects, making North Carolina safer and stronger; and
WHEREAS, the Executive Organization Act of 1973 established the Governor’s Crime Commission; and
WHEREAS, N.C. Gen. Stat. § 143B-1102 establishes the Juvenile Justice Planning Committee (the “Committee”) as an adjunct committee to advise the Governor’s Crime Commission on matters referred to it that are relevant to juvenile justice; and
WHEREAS, the federal Juvenile Justice and Delinquency Prevention Act of 1974, Pub. L. No. 93-415 (1974), as amended through Pub. L. 115-385 (Dec. 21, 2018), requires each state to establish a State Advisory Group to advise on the administration of juvenile justice and delinquency prevention programs and federal grant funding administered by the United States Department of Justice; and
WHEREAS, the Committee is well-suited to serve as such an advisory board consistent with federal law; and
WHEREAS, Exec. Order No. 312, 39 N.C. Reg. 344-345 (October 1, 2024), which was issued on August 29, 2024, is set to expire on August 31, 2026; and
WHEREAS, the Governor has determined that extending Executive Order No. 312 is necessary to ensure the continued operation of the Committee as North Carolina's State Advisory Group and to maintain the State's compliance with applicable federal law; and
WHEREAS, pursuant to Article III § 1 of the North Carolina Constitution and N.C. Gen. Stat. §§ 143A-4 and 143B-4, the Governor is the chief executive officer of the state and is responsible for formulating and administering the policies of the executive branch of state government; and
WHEREAS, pursuant to N.C. Gen. Stat. §147-12, the Governor has the authority and the duty to supervise the official conduct of all executive and ministerial officers.
NOW, THEREFORE, by the authority vested in me as Governor by the Constitution and the laws of the State of North Carolina, IT IS ORDERED:
Section 1. Extending Executive Order No. 312
Pursuant to N.C. Gen. Stat. § 147-16.2, Executive Order No. 312, which extended the Juvenile Justice Planning Committee is hereby extended to August 26, 2028.
Section 2. Effect and Duration
This Executive Order is effective immediately and shall remain in effect until August 28, 2028, or until rescinded or superseded by another applicable Executive Order.
